Anne Elise Herold Li is an intellectual property attorney in the New York office of Crowell & Moring. As a counsel in the Intellectual Property Group, Anne focuses her practice on patent, trademark, and trade secret litigation, counseling, patent procurement, freedom-to-operate, and due diligence. She represents a wide-range of clients, including biotechnology, biopharmaceutical, generic pharmaceutical, medical device, software, and mobile devices, varying from large corporations to start-ups. She litigates in both federal and state court, has been lead counsel in Inter Partes Review (IPR) proceedings, and has also successfully represented clients at the International Trade Commission (ITC). Her practice covers an array of technologies, with a special emphasis on biotechnology, Hatch-Waxman, medical device, and hand-held electronics industries. Her experience includes patent litigation, trade secret misappropriation, trademark enforcement, false advertising, and unfair competition cases.

Anne was recognized as a "Rising Star" in intellectual property litigation by Super Lawyers Magazine, New York Metro edition for 2013-2015.

Anne handles all aspects of intellectual property litigation, from pre-suit investigations, through discovery, Markman proceedings, summary judgment motions, trials, and appeals. Her experience also includes assisting clients with the evaluation of patents of third parties and rendering detailed opinions relating to patent invalidity, non-infringement, and unenforceability. She advises clients concerning intellectual property procurement and enforcement strategies. Anne is experienced in technology transfer agreements, such as drafting licenses and advising start-up clients on all aspects of intellectual property. 

Representative Matters

  • Lonza Sales AG v. Progenics Pharmaceuticals, Inc., Civ. Action No. 1:15-cv-00562-GMS, District of Delaware. Successfully represented Lonza AG on a breach of contract and misappropriation of trade secrets claim.
  • Successfully represented a medical device company in invaliding four patents on summary judgment in a case involving hundreds of millions of dollars in damages.
  • Successfully defended the makers of a mobile e-reader from claims of patent infringement made in the ITC concerning various hardware and software patents.
  • Successfully represented a client in biotechnology patent litigation brought against a recombinant DNA vaccine. Client received a valuable Markman ruling leading to summary judgment of non-infringement and favorable settlement.

Prior to joining Crowell & Moring, Anne was an associate at an intellectual property firm. Before that, Anne was an epidemiologist at the New York City Department of Health, where she received an award for her work on the anthrax outbreak in 2001. Prior to joining the Department of Health, Anne worked at the Centers for Disease Control (CDC). 

Anne also maintains an active pro bono practice. She was recently recognized as an "Empire State Counsel" by the New York State Bar Association for her pro bono work. Anne also received the Thurgood Marshall Award from the Association of the Bar of the City of New York in 2008 and the Archibald R. Murray Public Service Award, summa cum laude, for her pro bono work while in law school.

Anne earned her B.A. in psychology, focusing on biospsychology from the University of Chicago, her M.P.H in Epidemiology at the Rollins School of Public Health at Emory University, and her J.D. from Fordham University, where she was on the Intellectual Property Law Journal

Anne is admitted to the New York and District of Columbia bars. She is a member of the bar of The United States Court of Appeals for the Federal Circuit, as well as various federal district courts. She is also admitted to practice before the U.S. Patent and Trademark Office.
