Delayed Notification of Cyberattacks May Trigger HIPAA Breach Notification Rule

After identifying a ransomware attack in 2021, OSF Healthcare System waited until its forensic investigation had concluded before notifying the U.S. Department of Health and Human Services (HHS) — and the affected individuals — of the breach. The 110-day delay (nearly double the 60-calendar-day notification deadline mandated by the HIPAA Breach Notification Rule) triggered an investigation from HHS’s Office for Civil Rights (OCR). The health system’s investigation determined that protected health information (PHI) had been stolen.

License to Hack? The White House Greenlights Private-Sector Offensive Cyber Operations

On August 12, 2026, the White House released a National Security Presidential Memorandum (NSPM), marking a seismic shift in U.S. cybersecurity policy and establishing a framework to authorize private-sector companies to conduct offensive cyber operations—historically strictly prohibited by federal law—against foreign Cyber-Enabled Transnational Criminal Organizations (CE-TCOs).  It builds on an executive order issued in March 2026 that directed federal agencies to develop plans to combat cyber-crimes against Americans.

Supreme Court Confirms Contractual Loss of Bargain Without Repudiatory Breach

English law has long treated the choice between terminating for repudiatory breach and exercising a contractual termination right as consequential. Under the Financings[1] causation principle, a party exercising a contractual right for a non-repudiatory breach could recover losses accrued to the date of termination — but nothing more. Loss of bargain was out of reach unless the breach went to the root of the contract. A practical workaround, confirmed in Lombard,[2] was to designate the relevant obligation as a condition, elevating any breach to repudiatory status, but that device carries significant strategic risk if the termination is later found to have been wrongful.

"The AI Deception Machine: Deepfakes, Chatbots, and the New Frontier of Senior Fraud," U.S. Senate Hearing

On July 29, 2026, Partner Matthew F. Ferraro testified before the U.S. Senate Special Committee on Aging at the hearing, “The AI Deception Machine: Deepfakes, Chatbots, and the New Frontier of Senior Fraud.” Chairman Sen. Rick Scott of Florida invited Mr. Ferraro, who has been writing, speaking, counseling clients, and developing U.S. government policy related to AI-generated media and deepfakes since 2019, to share his long-standing expertise with the Committee. In his testimony, Mr. Ferraro explained the benefits and dangers, particularly to America’s seniors, of AI-generated media, possible policy responses, and steps all Americans can take to thrive in a world increasingly awash with synthetic media.
