While the antitrust enforcement agencies have always viewed associations as potential hotbeds for antitrust violations, recent activity and particularly the new Obama administration has upped the ante even further. Increased antitrust scrutiny was one of the planks in the Obama platform and the newly appointed enforcers are delivering on that promise. But exactly when it was needed most, the government recently provided new and concrete guidance on what associations need to do to comply with the antitrust laws.
