ICYMI: Crowell’s London R&I Team Appointed by Kroll Advisory in Bankruptcy of £330M Woodville Litigation Fund

London – July 29, 2026 [Updated Aug. 26, 2026]: Crowell & Moring's London Restructuring and Insolvency team has been appointed by Kroll Advisory in the administration of Woodville Consultants Limited (trading as Woodville Litigation Funding), a motor finance litigation funder with an estimated £330m loan book and more than 300,000 claims under its belt. The team first acted for a group of investors in successfully securing a contested administration order from the High Court and has since been retained by Kroll to assist in the wider administration process.

D.C. Circuit Upholds Designation of PFOA and PFOS as CERCLA Hazardous Substances

In a significant and unanimous ruling, the D.C. Circuit upheld the Environmental Protection Agency’s (“EPA”) final rule designating perfluorooctanoic acid (“PFOA”) and perfluorooctanesulfonic acid (“PFOS”) as “hazardous substances” under the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), denying the petitions of seven industry groups seeking to overturn that designation.[1] CERCLA, also known as the “Superfund Statute,” allows EPA to require potentially responsible parties to fund cleanup of hazardous substances.

The Pipe, Not the Posts: Part Deux

In our previous client alert, we addressed how algorithms and platform features that rely on user generated speech might not receive Section 230 protections because those features may not be considered platform user content.  In these instances, the platform might not carry user generated water through the pipe, but adds its own to the mixture.  At the same time, if it is true that there is less Section 230 protection, these same elements should then imbue the content with First Amendment protections as the expressive content of the platform.

"The AI Deception Machine: Deepfakes, Chatbots, and the New Frontier of Senior Fraud," U.S. Senate Hearing

On July 29, 2026, Partner Matthew F. Ferraro testified before the U.S. Senate Special Committee on Aging at the hearing, “The AI Deception Machine: Deepfakes, Chatbots, and the New Frontier of Senior Fraud.” Chairman Sen. Rick Scott of Florida invited Mr. Ferraro, who has been writing, speaking, counseling clients, and developing U.S. government policy related to AI-generated media and deepfakes since 2019, to share his long-standing expertise with the Committee. In his testimony, Mr. Ferraro explained the benefits and dangers, particularly to America’s seniors, of AI-generated media, possible policy responses, and steps all Americans can take to thrive in a world increasingly awash with synthetic media.
