Outplacement Reminder – The employer should take the initiative

Far too often, employers forget that in case of termination of an employment agreement of an employee who is 45 years old or older (this age limit can be lower in certain sectors), they should in principle provide him with an outplacement offer.

A short review of the basic principles that currently apply (Collective Bargaining Agreement 82) may be useful.

There are three criteria which the employee should meet at the time of dismissal in order to be entitled to outplacement:

  1. the employee may not have been dismissed for compelling reasons;
  2. the employee should be at least 45 years old and
  3. the employee should have at least one year of uninterrupted seniority within the company.

Since January 1, 2007, the conditions for these rules to apply have been reinforced and detailed:

  1. the employer must take the initiative of presenting the employee who meets the required conditions with a replacement offer within 15 days of the end of the employment agreement;
  2. the strict procedure to be followed by the employee and the employer has been adapted;
  3. certain categories of employees are no longer automatically entitled to outplacement (some part-time employees, employees on early retirement plan, …), but should make an explicit request for that purpose.

Outplacement herinnering – De werkgever dient het initiatief te nemen

Ondernemingen vergeten nog maar al te vaak in geval van ontslag van een werknemer van 45 jaar of ouder (binnen bepaalde sectoren is deze leeftijdslimiet nog lager), dat zij er sinds enige tijd in principe toe gehouden zijn om spontaan het initiatief te nemen om de betrokken werknemer outplacement aan te bieden.

Een kleine opfrissing van de momenteel toepasselijke basisregels (CAO nr. 82) kan dan ook nuttig zijn.

Om recht te hebben op outplacement, dient een werknemer aan drie criteria te voldoen op het ogenblik van het ontslag:

  1. het ontslag mag niet om dringende redenen plaatsgevonden hebben;
  2. de werknemer moet minstens 45 jaar oud zijn en
  3. de werknemer moet minstens één jaar ononderbroken anciënniteit hebben bij de werkgever.

Sinds 1 januari 2007, werden de toepassingsmodaliteiten van het outplacementregime nog verduidelijkt en verfijnd:

  1. de werkgever is sindsdien verplicht het initiatief te nemen om de ontslagen werknemer die voldoet aan de toepasselijke criteria een herplaatsingsvoorstel te doen binnen een termijn van 15 dagen volgend op het einde van de arbeidsovereenkomst;
  2. de door de werkgever en de werknemer te volgen (strikte) procedure werd aangepast;
  3. bepaalde categorieën van werknemers hebben niet langer automatisch recht op outplacement (bepaalde deeltijdse werknemers, bruggepensionneerden, …), maar moeten daar een uitdrukkelijk verzoek toe indienen.

Outplacement rappel – L’employeur doit désormais prendre l’initiative !

Les entreprises oublient encore trop souvent qu'en cas de licenciement d'un travailleur âgé de 45 ans ou plus (cette limite d'âge pouvant être inférieure dans certains secteurs), elles doivent dorénavant, en règle, lui faire d'initiative une offre d'outplacement. Un bref rappel des principes de base tels qu'en vigueur actuellement (CCT n° 82) s'impose.

Afin d'avoir droit à un outplacement, le travailleur doit répondre à trois critères au moment de son licenciement :

  1. il ne peut avoir été licencié pour faute grave ;
  2. il doit être âgé d'au moins 45 ans au moment de son licenciement et
  3. doit avoir au moins une année d'ancienneté ininterrompue auprès de son employeur.

Depuis le 1 janvier 2007, les règles de mise en œuvre de ce régime d’outplacement ont encore été renforcées et précisées :

  1. l'employeur doit désormais prendre l'initiative d'offrir au travailleur licencié qui répond aux conditions une offre de reclassement dans un délai de 15 jours suivant la fin de son contrat de travail ;
  2. la (stricte) procédure à suivre par employeur et travailleur a été adaptée ;
  3. certaines catégories de travailleurs n'ont plus automatiquement droit à l'outplacement (certains travailleurs à temps partiel, travailleurs prépensionnés, …) mais doivent en faire expressément la demande.

California Office of Health Care Affordability Notice Requirement for Material Change Transactions Closing on or After April 1, 2024

Starting next week, on April 1st, health care entities in California closing “material change transactions” will be required to notify California’s new Office of Health Care Affordability (“OHCA”) and potentially undergo an extensive review process prior to closing.
