New Obligations in Terms of Outplacement

The Act of 5 September 2001 on the improvement of the degree of employment of employees provides that employees (i) whose employer has terminated their employment contract, and; (ii) who are 45 years old upon dismissal and; (iii) have at least one year seniority in the company, are entitled to outplacement counseling.

The Act of 20 June 2006 (Official Journal of the Belgian State of 20 July 2006) now imposes an obligation on employers to inform employees who meet the above conditions of their right to outplacement counseling.

This measure came into force on 4 August.

Employers who do not comply with this obligation regarding outplacement risk having to pay 1,800 Euro compensation to the National Employment Office, compensation which will soon be increased by an administrative fine of a further 1,800 Euro.

Notwithstanding this supplementary obligation for the employer, any employee who wishes to use this outplacement shall still need to file an express request as stated in the Collective Labor Agreement 82.

Moreover, any dismissed employee who meets the necessary conditions for outplacement and does not request this outplacement or refuses to participate in it is also at risk of being sanctioned by the National Employment Office. The employee could lose his right to unemployment compensation for a certain time, since, in these circumstances, legally speaking, he will be considered as unemployed “owing to circumstances which are within his control”.



Nieuwe Verplichting Inzake Outplacement

De wet van 5 september 2001 tot verbetering van de werkgelegenheidsgraad van de werknemers voorzag reeds dat werknemers (i) wiens werkgever de arbeidsovereenkomst heeft beëindigd, (ii) die 45 jaar zijn op het ogenblik waarop het ontslag is gegeven en (iii) die minstens één jaar anciënniteit hebben, recht hebben op een outplacementbegeleiding.

De wet van 20 juni 2006 (Belgisch Staatsblad 20 juli 2006) heeft nu aan de werkgever de verplichting opgelegd om de werknemer die aan deze voorwaarden voldoet op de hoogte te brengen van zijn recht op outplacementbegeleiding.

Deze maatregel trad in werking op 4 augustus 2006.

Werkgevers die deze verplichting inzake outplacement niet nakomen, lopen het risico een vergoeding te moeten betalen van 1.800 euro aan de RVA, die binnenkort nog zal worden verhoogd met een administratieve geldboete van eveneens 1.800 euro.

Niettegenstaande deze bijkomende verplichting voor de werkgever, zal de werknemer die van outplacement gebruik wenst te maken, overigens nog steeds zoals voorheen uitdrukkelijk een aanvraag moeten doen zoals voorzien in CAO 82.

De ontslagen werknemer die aan de voorwaarden voldoet om recht te hebben op een outplacement, en die geen outplacement vraagt of weigert eraan mee te werken, kan overigens ook door de RVA worden gesanctioneerd. Hij kan het recht op werkloosheidsuitkeringen voor een bepaalde tijd verliezen aangezien de wet voorziet dat hij in die omstandigheden werkloos “wegens omstandigheden afhankelijk van zijn wil” wordt geacht.



Nouvelles obligations en matière de outplacement

La loi du 5 septembre 2001 visant à améliorer le taux d'emploi des travailleurs prévoyait que les travailleurs (i) dont l'employeur avait mis fin au contrat de travail, (ii) qui avaient atteint l'âge de 45 ans au moment de leur licenciement et (iii) qui avaient au moins une année d'ancienneté, avaient droit à une procédure de reclassement professionnel (outplacement).

La loi du 20 juin 2006 (Moniteur belge du 20 juillet 2006) rend désormais obligatoire l'obligation pour l'employeur d'informer le travailleur qui remplit les conditions susmentionnées de son droit à une procédure de reclassement.

Cette mesure est entrée en vigueur le 4 août 2006.

Les employeurs qui ne respecteraient pas cette obligation en matière de outplacement, s'exposent au risque de devoir payer une indemnité forfaitaire d'un montant de 1.800 Euro à l'ONEm. A cette indemnité devrait prochainement s'ajouter une amende administrative d'un même montant.

Le travailleur qui entend exercer son droit, comme avant, introduire une demande expresse en ce sens comme prévu par la convention collective de travail n° 82. Il aura d'ailleurs tout intérêt à le faire dès lors qu'il pourra, et c'est là une nouveauté, être sanctionné par une suspension temporaire de ses allocations de chômage s'il n'introduit pas une demande d'outplacement alors même qu'il remplit toutes les conditions prévues par la loi ou s'il ne collabore pas à cette procédure de reclassement.
