Overview

Kieran J. Tuckley is a counsel in the Mass Tort, Product, and Consumer Litigation Group of Crowell & Moring's Washington, D.C. office, where his practice focuses on environmental and toxic tort litigation.

Kieran defends Fortune 500 companies involved in complex products liability and toxic tort litigation pending in federal and state courts across the country. A natural investigator, Kieran often acts as a lead analyst in charge of building the factual record for his clients. He is adept at mining a corporation’s archive and synthesizing complex records for use in responding to discovery, preparing both fact and expert witnesses, and developing defenses for his clients. Building on his personal and professional interest in scientific developments, Kieran routinely tracks scientific literature of interest to the Toxic Tort bar, and is adept at quickly understanding complex scientific issues involved in the defense of his clients. He often applies this knowledge to the development and preparation of scientific experts used in litigation.

Kieran focuses a portion of his practice on critical scientific evidentiary issues. He is a frequent participant in Daubert/Frye briefing efforts that have led to the exclusion of plaintiffs' experts' speculative causation opinions. He has authored amicus briefs on scientific evidence and causation standards in toxic tort cases in the highest state courts of Maryland, Pennsylvania, and Virginia. Kieran has also co-authored a number of articles concerning scientific evidence and causation that have been widely utilized by the toxic tort defense bar.

Kieran is a passionate advocate on immigration issues and devotes his pro bono practice to defending vulnerable foreign nationals seeking protection from harm in their country of origin, including both affirmative asylum and defensive asylum cases. His proudest achievement was the successful pursuit of asylum for a Kenyan woman facing deportation from the United States after fleeing her Kenyan village after undergoing FGM and horrific domestic abuse.

  • National coordinating counsel for a major construction and mining machinery manufacturer and a telecommunications company involved in asbestos litigation.
  • National counsel for an oil company involved in MTBE litigation
  • Successful trial defense of a brake manufacturer in Los Angeles County Superior Court against the backdrop of a $3 million settlement demand.
  • Defending a pesticide manufacturer in one of the first lawsuits alleging that bee colonies were destroyed by an insecticide product used by local farmers. The case litigated to the expert stage and included significant scientific workup to defend the product and its active ingredient.
  • Representing a Swiss inhalation toxicologist in attempts to “tag” the scientist for a U.S. deposition based on attendance at a Virginia conference. The trial court rejected the subpoena, a decision affirmed by the Virginia Supreme Court.
