GAO To Staff New Contract Appeals Board

With the passage of the 2008 Legislative Branch Appropriations Act, Congress has established a Contract Appeals Board within the GAO to hear contract disputes under the Contract Disputes Act of 1978 regarding legislative branch agencies, offices, boards, and commissions, including Architect of the Capitol, GAO, GPO, Library of Congress, Congressional Budget Office, United States Capitol Police, and others. Michael R. Golden, Managing Associate General Counsel for GAO's Procurement Law Division, stated recently to members of the government contracts bar that GAO expects to staff its new Contract Appeals Board with permanent judges in the near future.

GSA Clarifies Permissibility of Upfront Payments for Software-as-a-Service Offerings

On March 15, 2024, the General Services Administration (GSA) issued Acquisition Letter MV-2024-01 providing guidance to GSA contracting officers on the use of upfront payments for acquisitions of cloud-based Software-as-a-Service (SaaS).  Specifically, this acquisition letter clarifies that despite statutory prohibitions against the use of “advance” payments outside of narrowly-prescribed circumstances, upfront payments for SaaS licenses do not constitute an “advance” payment subject to these restrictions when made under the following conditions:...
