Rob McNary is a counsel in Crowell & Moring's Antitrust & Competition Group in the Los Angeles office. His practice focuses on antitrust litigation and counseling. Rob has successfully litigated numerous antitrust and competition matters, including winning dismissal with prejudice of antitrust claims on motions to dismiss, and prevailing on summary judgment on competition claims in antitrust and patent litigation. He has argued before federal district courts and the California Court of Appeal.

Rob has represented several leading technology companies in antitrust and competition litigation. He represented various global technology companies in antitrust litigation involving electronic components suppliers, including In re TFT-LCD (Flat Panel) Antitrust Litigation, In re Cathode Ray Tube (CRT) Antitrust Litigation, In re Optical Disk Drive Products Antitrust Litigation, and In re Resistors Antitrust Litigation. He has also represented a global mobile telecommunications technology company in antitrust and licensing litigation over standards-essential patents, a telecommunications company in litigation over the exclusive service provider relationship for iPhones, a global financial services company in patent litigation brought by a primary competitor, and a leading technology company in a trade secrets matter following the hiring of an employee by a competitor.

Rob also represents companies in the healthcare and pharmaceutical industries in antitrust and unfair competition cases. He is currently defending a national pharmaceutical distributor in an antitrust class action concerning an alleged price-fixing conspiracy among manufacturers of generic pharmaceuticals. Rob has also defended an owner of nuclear pharmacies in federal antitrust litigation alleging violations of Sections 1 and 2 of the Sherman Act, and a national health care provider in federal antitrust litigation alleging monopolization and attempted monopolization. Before attending law school, Rob was a research analyst at the National Bureau of Economic Research, where his economic research work focused on health care economics, supporting studies on the effects of cardiac specialty hospitals and integrated cardiac care diagnosis and treatment on the cost and quality of medical care.

Rob is experienced with cases requiring testimony from multiple economic and technical experts, and he has supported experts offering testimony in antitrust and intellectual property cases. His antitrust and intellectual property litigation experience includes assisting experts on reports, preparing experts for deposition, and cross-examining opposing experts. He also enjoys counseling clients on trial strategy relating to expert testimony, and preparing expert witnesses for trial testimony.

Rob is actively involved in antitrust bar associations. Rob is Co-Chair of the American Bar Association Section of Antitrust Law Economics Committee, and co-author of multiple ABA Antitrust Section publications, including handbooks of the Civil Practice & Procedure, Distribution & Franchising, Economics, Exemptions & Immunities and Trade, Sports, & Professional Associations Committees. He has also served on the California Lawyers Association Antitrust, UCL and Privacy Section Executive Committee since 2018, and he currently co-chairs the Section’s annual Golden State Institute conference. Rob previously served as an articles editor for the CLA Antitrust Section’s official journal, Competition, and as a chapter author of the California State Antitrust and Unfair Competition Law Treatise annual updates. Rob is also a past chair of the Los Angeles County Bar Association Antitrust and Unfair Business Practices Section, and he has been recognized as a "Southern California Super Lawyer - Rising Star" in Antitrust Litigation annually since 2013.

Rob received his B.A., public policy, and M.S., engineering-economic systems & operations research, from Stanford University. At Stanford, he was awarded the Firestone Medal for Excellence in Undergraduate Research for his econometric analysis of telecommunications competition regulation. He earned his J.D. from the University of Chicago Law School, where he was a student fellow in law and economics, studying antitrust law and economics and completing price theory and industrial organization coursework in the economics department. During law school, Rob was a summer associate at an economic litigation consulting firm, where he supported economic and financial experts testifying in antitrust and securities litigation.

Rob is admitted to practice law in California and New York, and he is a Fellow of the American Bar Foundation. Prior to joining Crowell & Moring, he was an associate at another international law firm, where he worked primarily on complex multi-district litigation.
