Elena Klonitskaya is a counsel in the International Trade Group in Crowell & Moring's Brussels office. Elena has practiced EU and international trade/WTO law in Brussels since 2002. Her practice focuses on international trade compliance, investigations, enforcement, litigation, and policy. She has extensive experience advising clients on import and export trade regulation and cross-border transactions under various jurisdictions and international trade and investment treaties.

Elena counsels on the application of WTO rules and bilateral and regional trade agreements, represents companies in administrative investigations concerning anti-dumping, anti-subsidy and safeguard measures in the EU, the U.S., and other jurisdictions. She advises on international trade compliance and enforcement, national security measures, sanctions and export controls regulations, customs law (including valuation, origin, tariff preferences, duty suspension and drawback, refunds, marking), market access barriers, and various forms of discrimination and unfair distortions of competition, as well as on EU regulatory matters, notably related to energy, environment, and data privacy. In addition, Elena advises companies on data access and use, internet law, information security intellectual property rights, competition law, and employment and regulatory matters under Russian law.

Elena’s main clients are multinational and other private companies and associations, from the chemical, aluminum, steel, automotive, equipment manufacturing, energy, IT, high-tech, and defense sectors, as well as governments.

Representative Matters

  • Advised companies, associations, and governments on the application of WTO rules to market access barriers and various forms of discrimination and unfair distortions of competition. She has also advised businesses on the impact of bilateral and regional trade on their competitive position.
  • Advised on international trade compliance and represented companies from Russia, Ukraine, Belarus, Armenia, EU, U.S., and China in trade remedy cases in the EU, the U.S., and China (her experience covers anti- dumping, anti-subsidy, and safeguard investigations).
  • Advised on compliance with EU sanctions; represented private companies and individuals before EU courts in the application for annulment of sanctions as far as they affect applicants requesting the suspension of sanctions and interim measures.
  • Advised on international, EU and Russian customs and EU and Russian export control regimes for military and dual-use goods.
  • Advised private companies in the energy sector on EU regulatory matters, including third energy package, market access, security of supply, market integrity, EU environmental law (chemicals, REACH, and CLP), technical regulations and standards.
  • Advised on matters related to mergers, cartels, distribution agreements, and abuse of dominance under EU and Russian law.
  • Advised private companies before Russian courts in disputes related to competition and trade law matters involving direct effect of WTO law in Russia.
  • Represented private companies in disputes brought before the EU General Court and Court of Justice on trade remedy matters.
  • Advised on EU energy and environmental law and policy.
  • Advised on matters related to Russian data privacy law and the data localization requirement, and on copyrights under Russian law.
  • Advised governments on the WTO TRIPs agreement and conventions in the context of national treatment, parallel imports, and the exhaustion of rights principle.
