Brendan V. Mullan is a counsel in Crowell & Moring's Insurance/Reinsurance Group in the San Francisco office. Brendan focuses his practice on litigating and counseling insurers and reinsurers in all aspects of the dispute resolution process with an emphasis on complex insurance coverage disputes involving property and casualty, professional, and specialty line policies.

Brendan has represented insurers in high-stakes coverage matters for underlying mass tort, environmental contamination, product liability, and construction defect claims seeking hundreds of millions of dollars in insurance coverage. He has also represented insurers in matters involving aviation, sexual assault, law enforcement, professional liability, intellectual property, and Employee Retirement Income Security Act (ERISA) benefits. His litigation experience includes representing insurers in bankruptcy proceedings and reinsurance companies with disputes arising under facultative and treaty reinsurance contracts. In addition, Brendan has authored several amicus briefs on behalf of insurer trade associations. Brendan’s experience includes trials, arbitrations, and the handling of appeals. 

Representative examples of his practice include:  

  • Represented insurers concerning concussion-related claims involving the National Collegiate Athletic Association (NCAA), National Football League (NFL), National Hockey League (NHL), and World Wrestling Entertainment.
  • Represented an insurer in a coverage lawsuit for underlying bodily injury claims arising out of talcum powder.
  • Counseled an insurer on a major environmental contamination claim involving remediation costs and bodily injury damages exceeding several hundred million dollars.
  • Represented insurers with respect to claims for insurance coverage by universities and other institutions arising out of sexual molestation claims.
  • Represented an insurer in a coverage lawsuit following the crash and total loss of an aircraft.
  • Represented an insurer in a coverage and bad faith lawsuit arising out of construction defect and faulty design claims.
  • Counseled an insurer on contract wording for a policy covering architects and engineers.
  • Counseled a reinsurer on premiums for books of yearly renewable term life insurance.
  • Counseled insurers on Cumis counsel issues.

Brendan was recognized as a "Rising Star" by Northern California Super Lawyers in 2016 and 2017.

Before joining Crowell & Moring, Brendan worked in the San Francisco office of a national law firm where he represented insurers in a variety of coverage disputes and litigation matters.

Brendan graduated from San Francisco State University in 2005 with a B.A. in criminal justice. In 2009, he received a J.D. from the University of California, Hastings College of the Law, magna cum laude. During law school Brendan was a member of the Association of Communication, Sports, and Entertainment Society and completed the Civil Litigation Concentration. Brendan played varsity baseball while in college.
