Scott A. Timmerman


Scott Timmerman focuses his practice on patent prosecution as well as litigation. He also counsels clients regarding patentability, validity, infringement, clearance, licensing, patent portfolio management, and due diligence issues. With a background in computer technology and programming, Scott’s patent practice generally focuses on the electrical and computer arts. His practice has covered technologies such as computer software, networking, wireless technology, telecommunications (including standard-essential patents), blockchain technology, cybersecurity, electronic devices, memory systems, circuitry, digital encoding, navigation, and electro-optical devices, with extensive experience in Internet and e-commerce related technologies. Scott is familiar with numerous computing systems and programming languages.

Clients value not only Scott’s technical background, but also his communications skills and ability to work directly with inventors. Scott speaks their language. He quickly establishes what makes an innovation unique, and then writes a patent application that clearly describes the specific technology. Scott gets the technical details right in his patent applications, but also ensures they are easily understood. Both of these elements are critical in securing the broadest possible patent protection for his clients.

Always thinking forward, Scott maintains an active watch over his clients’ respective industries, ensuring the patents he drafts protect their competitive edge. Knowing that patent law is always evolving, Scott actively monitors market and technology changes that may affect his clients and provides advice tailored to their unique patent portfolios. Those changes may also include litigation, legislation, case law, or other developments that would affect his clients. For Scott, client service means identifying—and solving—problems before they arise.

  • Successfully prosecuted patents for a wireless power distribution and control system used to supply power wirelessly to various devices.
  • Successfully prosecuted patents for charging and billing for access to wireless power. 
  • Successfully prosecuted patent for generating a photoacoustic spectrum with reduced noise. Pulsed light beams on the target substance of the detector may be used to determine the target's optical absorbance as the wavelength of light is changed.
  • Successfully prosecuted patent for scanning probe microscopy with a band excitation signal that simultaneously excites a probe at a plurality of frequencies within a predetermined frequency band based on the excitation signal. 
  • Successfully prosecuted patent for diagnosis and treatment decisions based on information maximization with patient information and clinical records from other patients that can reduce the uncertainty in both diagnosis and treatment options.
  • Successfully prosecuted patent for discovering network information without requiring a connection to that network by storing network discovery information in a cache memory for future associations with the same network. 
  • Successfully prosecuted patents for an access point that advertises the availability of notifications, which may be received and interpreted by both associated and non-associated stations.
  • Successfully prosecuted patent for a continuous time noise shaping an analog-to-digital converter with a suppressed carrier pulse width modulated quantizer.
  • Successfully prosecuted patent for a power quality analysis system that is descriptive of power quality events and is easily configured and organized.
  • Successfully prosecuted patent for a capacitor from a Metal-Oxide-Metal process with metal layers arranged for maximizing capacitance between adjacent fingers, as well as between fingers of different metal layers. 
  • Successfully prosecuted patent for an inrush control circuit using a linear regulator in bypass mode that splits the bypass power MOS that are switched on with some delay during the power-on to control the initial inrush current. 
  • Successfully prosecuted patent for remapping logical block addresses for defragmentation that is managed at the storage device level and performed without changes to the physical location of data. 
  • Successfully prosecuted patent for grading blocks on a sliding scale to improve memory usage and for optimizing the competing needs of minimizing yield loss while minimizing testing defect escapes.
  • Successfully prosecuted patent for identifying a patterns in a sustained or continuous write operation. 
  • Successfully prosecuted patent for updating firmware of multiple non-volatile memory devices having diverse configurations using a common update file.  
  • Successfully prosecuted patent for optimizing the performance of an advertisement with correlations between advertisements and/or users.
  • Successfully prosecuted patents for determining the geographic range of a search query and for utilizing local intent to provide geographically relevant information in response to a search query.

Representative Litigations

  • Oberalis LLC v. Amway Corp., No. 2:15-cv-952 (E.D. Tex.). Represented Amway in patent litigation related to electronic search and improving the presentation and relevancy of documents from the search. 
  • eDekka LLC v. Amway Corp., No. 2:14-cv-400 (D. Del.). Defended Amway in patent infringement allegations regarding storing information from a user over a website.  The litigation was settled favorably. 
  • Qommerce LLC v. Amway Corp., No. 6:14-cv-107 (E.D. Tex.). Represented Amway in patent lawsuit related to XML technology.  The litigation was settled favorably. 
  • Princeton Digital Imaging Corp. v. Alticor Global Holdings Inc.,, Inc., Alticor, Inc., and Amway Corp., No. 13-cv-512 (D. Del.).  Defended Amway in a patent infringement matter regarding digital images. The case was voluntarily dismissed. 
  • Reshare Commerce, LLC v. Amway Corp., No. 12 cv 899 (D. Minn.). Represents Amway Corp. in a patent infringement matter involving the compensation of retailers based on Internet sales.  The case was voluntarily dismissed. 
  •, Inc. v. Exalead S.A., et al., No. 1:07 cv 787-SLR (D. Del.). Represented Exalead in a multi-defendant patent infringement matter relating to the display of thumbnails with hyperlinks on web pages. The case against Exalead settled while court was considering parties respective claim interpretation and summary judgment motions.
  • Soverain Software, LLC v. Amway Corp., et al., No. 6:09 cv 274 (E.D. Texas). Represented Amway Corp. in a multi-defendant patent infringement matter involving electronic shopping carts and session identification technology on a website. The matter was pending before Judge Davis before reaching confidential resolution through court-ordered mediation process.
