Jacinta Alves, a partner in our Washington, D.C. office, practices in the Health Care and Government Contracts groups. Jacinta's practice includes representing and counseling health care providers, managed care organizations, and a variety of government contractors and grantees in a wide array of litigation, regulatory, and compliance matters. Her practice includes counseling and representing entities on matters related to internal and government investigations, the physician self-referral law (Stark Law), the Anti-Kickback Statute, the FCA, receipt of government overpayments, procurement and grant fraud, suspension and debarment, and other federal and state fraud and abuse issues. In 2015, Jacinta served for six months as interim General Counsel and Chief Compliance Officer of a healthcare non-profit that provided nearly $1 billion in assistance, in part, to specifically assess the adequacy of the organization’s compliance and audit plan in light of identified risk areas.

Recent representative engagements include:

  • Represented government contractors and health care entities in government investigations and internal investigations relating to, e.g., the civil False Claims Act, the Anti-Kickback Statute, and the Physician Self-Referral (Stark) Law.
  • Represented hospital systems in self-disclosures pursuant to Centers for Medicare & Medicaid Services' Self-Referral Disclosure Protocol.
  • Assisted clients in the development, enhancement, and implementation of compliance programs.
  • Assisted government contractors in contract review and negotiation with federal and state agencies.
  • Counseled government contractor regarding application of TRICARE regulations to performance under a contract.
  • Represented grantee in responding to federal agency's financial and administrative audit of grantee's performance.
  • Counsel of record in representation of a health care entity in a contract claim against the District of Columbia.
  • Successfully defended protest of $330 million Centers for Medicare and Medicaid Services award for Medicare administrative contractor services (Wisconsin Physicians Service Insurance Corp., B-401068.14 et al., Jan. 16, 2013, 2013 CPD ¶ 34).  
  • Successfully defended protest of DoD TRICARE award valued at over $20 billion for a comprehensive managed health care program (TriWest Healthcare Alliance Corporation, B-401652.12, et al., July 2, 2012, 2012 CPD ¶ 191).

She obtained her Leading Professional in Ethics and Compliance (LPEC) certification in 2014 through the Ethics and Compliance Officer Association (ECOA), which has since merged with the Ethics Resource Center to form the Ethics & Compliance Initiative.

Jacinta received her J.D. from Boston University School of Law. While at Boston University, Jacinta participated in the Legislative Drafting Clinic and served as an editor. Jacinta graduated from Emory University as an Emory Scholar with a B.A., majoring in both psychology and economics, with a concentration in law and economics.
