Liz Figueira is counsel in the New York office and is a member of the Commercial Litigation and Advertising & Product Risk Management groups. Her practice serves a variety of clients, including several in the financial services industry; multinational commodities companies; and media, consumer product, and sports companies. Her matters often focus on complex business transactions and intellectual property disputes in both federal and state courts. She also advises clients on a variety of e-discovery issues, both within the context of pending lawsuits and on a consulting basis.

Beyond her litigation practice, Liz has counseled clients on a variety of advertising issues, including claim substantiation issues and proceedings before the National Advertising Division of the Better Business Bureau. She is a contributor to Crowell’s Food and Beverage Industry Tracker, which provides regular updates on the food and beverage industry regarding litigation, safety, labeling, ingredient, and nutritional issues.

She has also counseled clients on a broad range of intellectual property license agreements, media distribution agreements, sponsorship agreements, retailing agreements, and assignment and administration agreements.

Liz is active in pro bono litigation matters and has worked with New York Legal Assistance Group, Volunteer Lawyers for the Arts, and the Humane Society. In 2014, she worked with the DNA expert that helped to secure a victory at the trial level for a client on death row in Ohio. While the post-conviction petition was granted and the trial judge acquitted the client on one count and ordered a new trial, the State has appealed the decision and the case remains pending.

Liz earned her B.A. in European history, summa cum laude, from the University of Pennsylvania in 2002. In 2006, she earned her J.D. from the New York University School of Law. While in law school, she was a member of the Moot Court's Competitions Division and later served as Chair of the Moot Court Board. She also served as a trainer for the Small Claims Court Mediation Program.

Representative Matters

  • Managed discovery and motion practice in false advertising and trademark dispute on behalf of Playtex Products LLC (a subsidiary of Edgewell Personal Care Company). The case settled in May 2016 prior to trial.
  • Managed e-discovery collection, production and review, depositions and motion practice for a lending syndicate of more than ten major financial institutions in a litigation concerning an Article 9 foreclosure. After submission of trial affidavits (in lieu of direct testimony) by all witnesses, the parties reached an out-of-court settlement.
  • Managed multiple contract disputes on behalf of Fortune 100 financial services and commodities company.
  • Prosecuted and defended theft of trade secret claims on behalf of a variety of clients, including a software company and a consumer products company.
  • Represented class plaintiffs in YouTube litigation. Served as lead associate during discovery for the plaintiff class, including preparing over 15 class witnesses for depositions and conducting offensive and defensive depositions independently. Drafted summary judgment and appellate court motion papers.
  • Defended Major League Baseball in sponsorship dispute with Budweiser in the Southern District of New York. Analyzed contractual history and other key documents as well as drafted the answer. (Anheuser Busch, Inc. v. Major League Baseball, Properties, Inc.).
  • Defended the New York Jets in contract and consumer fraud dispute with season ticket holders.
  • Counseled international sports league, where duties included analysis of sports client’s television broadcasting, online distribution, and sponsorship agreements extending back to 2001.
  • Represented health and beauty manufacturer where significant duties included drafting opposition to a motion to dismiss on false advertising claims.
  • Advised music publishers, where duties included performing chain of title litigation due diligence for over 80 musical compositions including works covered by the 1909 Copyright Act and due diligence for catalog acquisitions.
