Daniel Wierzba is an associate in the Government Contracts Group in Crowell & Moring’s Los Angeles office. His practice focuses on representing contractor clients in both counseling and litigation, including government compliance issues, internal investigations, disclosures, bid protests, contractual performance disputes, and appeals of contracting officer decisions before Boards of Contract Appeals. Mr. Wierzba has extensive experience with the FAR, DFARS, ITAR, and OFAC regulations, and he was recently elected as president-elect of the National Contracts Management Association Los Angeles South Bay Chapter.

His notable cases include successfully defending a government contractor against allegations of False Claims and retaliation by a former employee, which was affirmed on appeal by a Ninth Circuit Court of Appeals published opinion; a jury trial victory on behalf of a federal government contractor in a dispute with a supplier; a federal court trial victory where a subcontractor client was awarded nearly seven figures in damages for its pass-through contract and Spearin claims against a government entity; and a federal court trial resulting in a complete defense judgment in favor of general contractor client, which was subsequently affirmed on appeal by a Fourth Circuit Court of Appeals published opinion.

Representative Engagements

  • Represented federal services contractor against allegations of False Claims Act violations and retaliation by former employee. Client successfully obtained summary judgment at federal trial court, which was affirmed on appeal by the Ninth Circuit Court of Appeals in a published opinion. 
  • Represented large aerospace contractor in appeals of cost allowances by DCMA of indirect rate cost of independent research and development and capital equipment. Matters settled before discovery was initiated.
  • Represented municipality government in federal court against contractors and U.S. government for the defective design and construction of a new port.
  • Represented large aerospace contractor in breach of contract and fraud case brought by supplier. Client successfully obtained judgment during jury instructions. 
  • Represented bus company in claims related to alleged tortious injuries. One matter appealed to the Arizona Supreme Court successfully overturned an area of law that had dated back to 1910. 
  • Represented large construction company in claims of breach of contract by subcontractor. Client successfully obtained complete defense verdict, which was affirmed on appeal by the Fourth Circuit Court of Appeals in a published opinion.
