Benjamin Blase Caryl is an associate in the International Trade Group in Crowell & Moring’s Washington, D.C. office. He helps manufacturers, importers, exporters, workers, and businesses compete in the global marketplace by maximizing opportunities and navigating challenges presented by international trade laws and policies.

Ben represents clients in trade remedy — primarily antidumping (AD) and countervailing duty (CVD), but also safeguard — proceedings before the U.S. Department of Commerce (USDOC), the U.S. International Trade Commission (USITC), U.S. Customs and Border Protection (CBP), the U.S. Court of International Trade, and the U.S. Court of Appeals for the Federal Circuit. Ben also advises companies and trade associations on other international trade and investment issues, including customs, U.S. trade policy, World Trade Organization (WTO) issues and disputes, U.S. free trade agreements (FTAs) and negotiations, export controls, economic sanctions, global strategy, foreign trade zones, market access, and supply chain compliance.

Ben has represented a wide array of industries, including steel, alloy and specialty metals and downstream products, aluminum, agriculture, chemical, consumer products, energy, food, minerals/ores, shipping, solar, telecommunications, and textiles.

Prior to joining Crowell & Moring, Ben was appointed by President Obama to serve as counsel to USITC Commissioner Charlotte R. Lane, where he advised Commissioner Lane on a variety of AD/CVD injury investigations, sunset reviews, appeals and remands thereof, and USITC economic studies. Ben also served in the USDOC’s Import Administration, Office of Non-Market Economy (NME) Compliance, where he advised and briefed government officials on AD investigations and administrative reviews involving companies from NME countries, primarily China. Ben previously practiced international trade law at another firm in Washington, D.C., where he primarily represented U.S. manufacturers in AD/CVD proceedings.

Ben has an active pro bono practice that has included assessing Libya’s international trade and customs laws in conjunction with U.S. State Department and the American Bar Association’s Rule of Law Inititiative and assisting an LGBT man from Ghana obtain asylum in the United States. Ben is also a member of Crowell & Moring Lawyer Development Associates Committee.

Representative Engagements

  • Defeated the first U.S. CVD case against imports from Russia.
  • Obtained the only USITC termination of the final AD/CVD investigations of imports of cold-rolled steel from Brazil, China, India, Japan, Korea, Russia, and the United Kingdom for the largest steel producer in Russia.
  • Obtained the only post-petition scope exclusion in the AD/CVD investigations of imports of cold-rolled steel for specialty steel producer in Japan (all other Japanese producers now face AD duties of over 70 percent).
  • Obtained scope exclusions from the AD/CVD investigations of iron mechanical transfer drive components from Canada and China for Fortune 10 and Fortune 100 U.S. multinational manufacturers, avoiding potential AD/CVD duties of over 400 percent.
  • Advised clients on various customs matters, including initial prior disclosures, audits, and surveys.
  • Obtained or maintained trade relief from unfairly traded imports in AD/CVD proceedings for U.S. manufacturers of activated carbon, brass sheet and strip, honey, polyester staple fiber, steel wire rod, and large power transformers.
  • Assisted in the representation of U.S. steel wire shelving producers to successfully defend the constitutionality of USDOC’s application of CVDs to imports from China.
  • Assisted in the representation of U.S. honey producers in anticircumvention proceedings at the USDOC regarding Chinese imports of blends of honey and rice syrup that were circumventing the AD order on honey from China.
  • Regulatory and legislative government relations activities, including creating WTO-consistent trade remedy legislation and lobbying Congress on international trade issues.
  • Assisted in WTO dispute settlement proceedings involving challenges to U.S. and foreign AD/CVD orders in coordination with the Office of the U.S. Trade Representative.
  • Advised companies of their rights under the WTO and U.S. FTAs, including the North America Free Trade Agreement (NAFTA) and the U.S.-Korea Free Trade Agreement (KORUS).
  • Advised and advocated on behalf of companies on the Trans-Pacific Partnership (TPP) free trade agreement between the United States, Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, and Vietnam.
  • Advised a leading specialty chemicals and performance materials company on global strategic international trade remedy options.
  • Assisted in creating an export control compliance program for a global chemical manufacturer.
  • Advised stainless steel producer and telecommunications service provider of U.S. export controls and economic sanctions.
  • Advised companies on U.S. foreign trade zone (FTZ) subzones, both offensively and defensively.
