Andrew Pruitt


Andrew Pruitt is a partner in the firm’s Litigation Group. He litigates complex commercial disputes and high-profile government enforcement actions, including consumer protection, class action, unfair competition, false marketing, product liability, and antitrust matters. He is also a trial lawyer with first-chair jury trial experience in federal court.

Andrew’s clients include global Fortune 500 companies spanning a range of industries, including technology, consumer products, automation, manufacturing, and digital services. In addition to representing clients in high-stakes litigation, he counsels businesses on risk mitigation and crisis management strategies in matters involving significant financial and reputational exposure.

His track record includes crafting winning trial strategies in commercial disputes turning on cutting-edge technologies and unprecedented legal questions. Andrew is experienced in guiding the work of technical experts in a wide variety of scientific disciplines, including engineering, hydraulics, fluid dynamics, multiphase flow, acoustics, hydroclimatology, economics, industrial organization, and toxicology.

Andrew’s litigation and trial victories have been featured in national legal publications like The American Lawyer and Law360. His groundbreaking work in matters raising novel scientific and legal issues has also been featured in Science, Nature, and Wired.

In addition to trial-level work in federal and state courts nationwide, Andrew has briefed high-profile appeals before the U.S. Supreme Court, Second Circuit, Fourth Circuit, Ninth Circuit, and D.C. Circuit, and has successfully argued before the Ninth Circuit.

Andrew is an active pro bono advocate and regularly represents political refugees from the Middle East, Africa, and other regions in asylum cases in the United States.

Prior to joining Crowell & Moring, Andrew was a partner at a major global law firm in Washington, D.C.

Complex Commercial Litigation & Arbitration
  • Represented global oil & gas company in complex, multidistrict litigation and government enforcement action arising out of the Deepwater Horizon oil spill in the Gulf of Mexico, including multiple bench trials in federal court.
  • Represented U.S. state in rare “original jurisdiction” dispute in the U.S. Supreme Court related to equitable apportionment of interstate waters, including a bench trial before a Special Master and multiple appeals before the Supreme Court.
  • Represented global automation and robotics company in defense of complex litigation concerning the UN Oil-For-Food Program and claimed transactions with the government of Iraq.
  • Represented major health plans in litigation and arbitration against retail pharmacies and pharmacy benefit managers seeking to recover hundreds of millions of dollars in prescription drug reimbursement overpayments.
Consumer, Product & Class Action Litigation
  • Represented global automaker in federal consumer and product class action litigation alleging brake defects in millions of vehicles, associated with one of the largest vehicle recalls for any automaker since 2014.
  • Representing global automaker in consolidated, 50-state consumer and product class action litigation alleging defective high-pressure fuel injection pumps in diesel vehicles.
  • Represented global parks and resorts company in consumer class action litigation in federal and state court associated with the temporary closure and reopening of theme parks and resorts during the COVID-19 pandemic.
  • Represented global digital services company in defense of consumer class action litigation alleging unfair and deceptive practices and an alleged kickback scheme associated with pharmacy contracting practices.
Antitrust & Competition
  • Represented global manufacturing and chemical company as trial counsel in first-ever FTC administrative trial to block an unconsummated, multibillion-dollar worldwide acquisition.
  • Represented major student lender/loan servicer in multistate AG enforcement litigation and government investigations alleging unfair competition, consumer fraud, deceptive business practices, and false advertising.
  • Represented global pharmaceutical company in state AG enforcement litigation alleging unfair competition, fraud, and violations of the federal False Claims Act.
  • Represented global automaker in multiple class action lawsuits alleging violations of California’s Unfair Competition Law (UCL).
