Representative Engagements

  • Automotive rollover class actions. Represented a major domestic automobile manufacturer, in which we defeated a proposed class certification which potentially involved more than 400,000 past and present owners of 1972 and 1986 four wheel drive sport utility vehicles.
  • Civil False Claims Act case alleging violations of the Clean Water Act. Won a jury verdict in the district court in favor of the defendant government contractor and successfully opposed a motion for a new trial.
  • Filing false reports with and withholding information from a federal agency. A jury in federal court in Florida returned a verdict of not guilty on all counts after the trial of a transportation company accused of filing false reports with and withholding information from a federal agency.
  • Nationwide bus company. Defended in massive litigation before the National Labor Relations Board. Because the strike forced the employer to seek bankruptcy protection, we also defended the company in the bankruptcy court.


  • Won verdict after three-week trial on conspiracy and monopolization charges.
  • Achieved summary judgment on eve of trial in state court on state law antitrust claims.
  • Won summary judgment for railroad client on conspiracy, monopolization and "essential facility" claims; preserved dismissal of all claims on appeal.
