Crowell & Moring’s Government Contracts Public Policy and Federal Marketing practice is well-positioned to support government contractors’ public policy advocacy and marketing initiatives and assist them with their ongoing and future contractual relationships with federal agencies. This support includes strategic initiatives to reduce burdensome contracting requirements imposed by the Federal Acquisition Regulation and agency FAR supplements.  More specifically, our team provides a wide range of services, including business intelligence; outreach to agency procurement officials and program managers; development of advocacy position papers and persuasive messaging; assistance with marketing strategies and proposal development; and advocacy support for acquisition reform initiatives. In providing these services, Crowell & Moring has a successful record given its excellent relationships with procurement policy decision-makers in Congress, the Office of Federal Procurement Policy, DoD, GSA, DHS, and most of the agency acquisition offices. 

Rob Burton, a partner in Crowell & Moring’s Government Contracts Group, leads a team of professionals with strong ties to Capitol Hill and the procurement executives at federal agencies. Rob is uniquely positioned to support clients on procurement policy issues and marketing strategies, having recently served in the Executive Office of the President as the Acting and Deputy Administrator of the Office of Federal Procurement Policy, the top career procurement official in the U.S. Government. Our team also includes a former Administrator, Office of Federal Procurement Policy, Office of Management and Budget, a former Assistant Counsel, Office of the General Counsel, U.S. Navy, a former advisor to senior leadership at the Department of Homeland Security, and the only Procurement Fraud Remedies Coordination Official currently in private legal practice.  Members of the practice have successfully supported clients in their efforts to enact acquisition reform legislation, change procurement regulations and policies, market products and services to the agencies, obtain competitive procurement opportunities, and resolve contract performance issues. In most instances, Crowell & Moring’s early outreach efforts have avoided formal contract disputes and enhanced contractor relationships with the agencies.

Our representative experience includes:

  • Assisting clients with marketing and competing for contracting opportunities at a wide range of federal agencies, including DoD, VA, DHS, GSA, SBA, and IRS.  For example, our team has successfully persuaded agencies to compete procurements that were historically sole source and has helped shape statements of work during the early stages of a procurement.
  • Advocating for acquisition-related legislative and regulatory changes, including the successful passage of the Program Management Improvement and Accountability Act and the inclusion of acquisition reform provisions in the annual National Defense Authorization Acts.
  • Resolving contentious contract management issues, which negatively impact the performance of existing client contracts, with senior procurement officials at almost every federal agency.
  • Working with companies and non-profit associations to develop acquisition reform recommendations that will reduce contractor risk and regulatory burdens associated with the federal procurement process.
