Water Supply and Treatment


Crowell & Moring attorneys have been involved in numerous private and public sector water supply and treatment projects to meet the need for additional water supply and treatment facilities to satisfy growing residential, commercial, and industrial demand. Our experience includes several “first of a kind” engagements, including the only large scale desalination facilities in the U.S. and privately financed wastewater treatment projects for Pemex refineries in Mexico.

Our water sector clients include project sponsors, construction and operations contractors, municipal water agencies, and debt and equity investors. Our engagements include all aspects of water project development (including the negotiation of construction and O&M agreements as well as agreements for water sales and transportation and wastewater treatment), project financing, and project acquisition/disposition.

Representative Engagements:

  • Poseidon Water in connection with the development and financing of an expansion of the wastewater treatment facility for the City of Cranston, Rhode Island
  • Orange County Water District in connection with a construction and operating agreement for the District’s Groundwater Replenishment Project.
  • Poseidon Water in connection with the development and financing of a 50 million gallon-per-day desalination project in Carlsbad, California. The project was named “Deal of the Year” by Project Finance magazine.
  • Trident Global Water Partners in connection with a dual-currency (US$, JP¥) refinancing of a portfolio of Mexican wastewater treatment projects (named a “Deal of the Year” by Project Finance magazine).
  • Poseidon Water in connection with its sale of a controlling interest in 5 wastewater treatment projects in Mexico to affiliates of Mitsui & Co. Ltd.
  • A private equity fund in its potential investment in water treatment and supply projects in Colorado and Florida.
