On 28 February 2019, the Belgian Parliament adopted a new Code of Companies and Associations, which i.a. integrates the law on non-profit associations into the Code. This is part of a broader development that has resulted in non-profit associations becoming “enterprises” subject to the Code on Economic law and insolvency law.
During this Open Table we will discuss the new landscape for non-profit associations, including the new rules on director’s liability. We will also talk about the UBO registration obligation for non-profits.
Finally, non-profit associations often struggle with the application of public procurement rules, both as an entity that may be obliged to comply with these rules, as well as when subscribing to a public tender.
