Crowell & Moring Partner Ian Laird Co-Authors Book, Evidence in International Investment Arbitration

Washington – April 26, 2018: Crowell & Moring LLP partner Ian A. Laird has co-authored a first-of-its-kind book that systematically explores the law of evidence in investor-state arbitration. “Evidence in International Investment Arbitration” is a guide for practitioners in investment arbitration disputes, while also offering academics a perspective on the practical elements affecting the treatment of evidence in the area. Laird, co-chair of the firm’s International Dispute Resolution Group, co-authored the book with Frédéric G. Sourgens, an associate law professor at Washburn University School of Law and Kabir Duggal, a senior associate at Baker & McKenzie LLP.

The book establishes the rules of evidence as currently recognized by investor-state arbitral jurisprudence and examines these against those recognized in the traditional rules of international law, as well as against those codified by the IBA Rules on the Taking of Evidence in International Arbitration. The chapters cover a broad range of evidence-based topics, including: burden and standard of proof, presumptions and inferences, witness and expert evidence, exclusionary rules including privileged and confidential documents, and annulment.

With more than 20 years of government and private-practice experience, Laird is considered a pioneer in the field of international investment arbitration, and he represents a range of clients in a range of proceedings involving disputes between corporations and foreign sovereign governments. His cases have involved Egypt, Dominican Republic, El Salvador, Lithuania, Kazakhstan, Mongolia, and Turkey. He is an adjunct professor at Columbia University School of Law and Georgetown University Law Center.
