Discovery Fail – In the age of emails, text messages, Snapchats and voice memos, it isn’t entirely unheard of to send an attachment to someone you didn’t mean to, or to accidentally CC a message to half the office. What is a bit more high-stakes, and rarer, however, is when an attorney makes such a mistake during discovery—that is, by mistakenly producing a client’s privileged information to the other side, reports Isha Marathe. One of the most momentous recent examples is what happened during Infowars owner Alex Jones’ trial in a courthouse in Austin, Texas. Mary Mack, CEO and chief legal technologist at Electronic Discovery Reference Model (EDRM), said the moment is likely “going to be a gift to e-discovery,” precisely because it brings to light the importance of e-discovery best practices.
