Government Contract Claims: The Expanding Litigation Battlefield
March 8, 2007
This program will cover recent litigations involving alleged false or inaccurate contractor estimates as bases for government fraud or false claim counterclaims. With increasing frequency, contractors and government agencies have clashed over whether "false" or "inaccurate" estimates trigger liability in fraud suits, defective pricing cases, and government audits.
Panelists will discuss recent cases in which such estimates have been at the heart of the litigation battles, such as Wynne v. UTC Fed Cir and BCA series of cases including:
- Wynn v. United Technologies, Corp. , No. 05-1393, 2006 WL 2466286 (Fed. Cir. Aug. 28, 2006)
- United Technologies Corp ., ASBCA Nos. 51410, 53089, 53349, 04-1 BCA 32,556, modified on recon., 05-1 BCA 32,860
- The recent decision in Daewoo Engineering and Construction Company, LTD v. United States, (COFC No 02-1914C, Hodges, Oct. 13, 2006, involving an Army Corps of Engineers contract)
Crowell & Moring's David Bodenheimer will participate in this program.
