Whistle(blowing) While You Work: GAO Recommends Improvements to Whistleblower Protections Pilot Program

Last week, the U.S. Government Accountability Office (GAO) published a report highlighting necessary improvements to implement the Whistleblower Protections Pilot Program, a program introduced in the National Defense Authorization Act for Fiscal Year 2013 applicable to contractors, subcontractors, and grantees that expanded whistleblower rights against reprisal. As discussed in greater detail on our blog, the GAO emphasized that 1) reports of investigated reprisal complaints must be forwarded to the appropriate agency head for a final determination, 2) contracts exceeding the simplified acquisition threshold must contain a Federal Acquisition Regulation clause that requires contractors to inform employees of their rights under the pilot program, and 3) agencies must communicate with contractors to help them understand their responsibilities under the program.
