Supreme Court To Decide Who Qualifies As An "Original Source"
The Supreme Court heard argument today in Rockwell International Corp. v. United States (No. 05-1272) on the question of when a Relator is an "original source" who may bring an action despite the underlying facts having been previously "publicly disclosed." The circuit courts are split on the issue, with the case before the Court involving the Tenth Circuit's broad reading, which permits the filing of what other circuits would deem parasitic complaints.
