FCA Treble Damages Awarded For Grant Fraudulently Induced, Despite Successful Performance
In U.S. ex rel. Longhi v. Lithium Power Tech., Inc. (July 9, 2009), the Fifth Circuit affirmed judgment for the government awarding treble the grant amount under the False Claims Act when the awardee used false statements to induce the award under the Small Business Innovation Research program, despite the fact that the contractor performed successfully.
