2019's Defective Pricing Forecast: Gusty Audits, Frozen Sweeps, and TINA Hail

After basking in the sunny news of winning new awards and work, contractors too often feel the bitter chill of defective pricing audits, final decisions, and even fraud actions based on the Truth in Negotiations Act (TINA). In his recent article in The Government Contractor entitled “2019’s Defective Pricing Forecast: Gusty Audits, Frozen Sweeps, and TINA Hail,” Partner David Bodenheimer foresees five stormy areas for defective pricing in 2019: (1) too many audits rubber-stamped into final decisions; (2) too many garden-variety audits twisted into fraud actions; (3) needless audits caused by hurried TINA certifications after the Pentagon killed sweeps; (4) more confusion triggered by the disconnect on prime and subcontract TINA thresholds; and (5) more final decisions collapsing once litigation starts.
