Dr. Werner Berg, LL.M. is a partner in the Brussels office of Crowell & Moring’s Antitrust Group. His practice includes the entire spectrum of EU and German antitrust law. He has particular expertise in the area of merger control including referrals to and from the European Commission, complex remedy issues and second phase procedures both at the EU and German level. Werner regularly advises clients on horizontal cooperation, vertical agreements and dominance issues both in German and EU competition law. He has been involved in numerous litigation matters before the European Community courts and in several cartel investigations of the European Commission. Werner has also handled competition law related arbitration cases at the ICC and DIS level. He has worked in a broad range of industries notably in consumer goods, life sciences/pharmaceuticals, the chemical industry, energy and telecoms.

Recent matters include:

• Achieving early clearance in a 5 billion USD outsourcing transaction with the European commission.
• Successfully representing a multinational company as third party intervener in multiple jurisdictional merger control procedure.
• Successfully representing utility company in abuse of dominance procedure.

Werner received his law degree from the University of Trier in 1992 and a Master of Laws degree from the University of East Anglia, UK, in 1992. He qualified for the German Bar in Berlin in 1997. In the same year he received a Dr. iur. from the University of Trier and was admitted to the German Bar. He was a scholar of the Land Rhineland-Palatinate, the DAAD and ERASMUS. Werner wrote his doctoral thesis (Health Protection a task of the European Union) in cooperation and with the support of the German Federal Health Ministry. He is admitted at the Higher Regional Court (Oberlandesgericht) of Cologne.

Before joining Crowell & Moring, Werner was a partner at Gleiss Lutz Rechtsanwälte since 2002. He is a member of the International Bar Association, the Association for European Law and the Antitrust Law Study Group and lectures German competition law at the ICC, Queen Mary College, University of London. Werner is recommended as recognized expert in EU and competition law in European Legal Experts, JUVE, the EMEA Legal 500 and Chambers Global.
