Adrian Fontecilla is an associate in the Antitrust Group at Crowell & Moring's Washington, D.C. office, where he represents clients in complex antitrust litigation, defends companies involved in government investigations and provides antitrust counseling to clients. Adrian has represented clients in arbitrations and in federal courts throughout the United States and has handled matters before the Department of Justice and various state agencies. He has handled antitrust matters in various industries, including aerospace, agriculture, finance, health care, packaging, telecommunications, and transportation.
Adrian's practice also involves a special focus on e-discovery matters, including advising clients on managing e-discovery risks and obligations and on developing and implementing defensible predictive coding and other technology-assisted review processes. His experience includes developing and negotiating comprehensive discovery plans; designing and implementing complex electronic search protocols; developing and managing all aspects of preservation, collection, processing, review and production protocols involving large amounts of ESI; examining witnesses on document retention efforts; and prosecuting spoliation claims.
Representative matters include:
- Represented Class I freight railroad in multidistrict class action litigation alleging a price-fixing conspiracy related to fuel surcharges.
- Defended global office machine manufacturer against claims by copier dealers under Sections 1 and 2 of the Sherman Act, RICO, and other federal and state laws.
- Represented publishing company in antitrust investigations related to eBooks.
- Defended leading bank against price-fixing, tying, and exclusive dealing class action claims brought by a putative class of merchants with respect to fees paid for payment card processing.
Adrian graduated from the University of Maryland in 2005 and received his J.D., with honors, from The George Washington University Law School in 2009. He is a member of the Antitrust Section of the American Bar Association and a member of the Seventh Circuit Electronic Discovery Pilot Program Committee. Prior to joining the firm, Adrian practiced in the New York and Washington, D.C. offices of an international law firm, where his practice focused on representing clients in complex commercial litigation, including antitrust, securities, and breach of contract actions.
