Retail: Antitrust
Crowell & Moring's antitrust lawyers offer unparalleled client service by investing in understanding your business, your company's culture and risk tolerances.
Our attorneys have a broad range of experience at the Department of Justice, the Federal Trade Commission, and the European Commission. This experience has carried over to our private practice, where we appear before those same agencies as well as other regulatory agencies involved in competition policy. We also have a national and international complex civil litigation practice, in federal and state courts, at both the trial and appellate levels. Additionally, we work closely with our clients to reduce antitrust risk, by conducting thousands of on-site and on-line antitrust training sessions, and by establishing effective compliance and audit programs.
Representative matters in the retail industry include:
- Defended an international retailer in consumer class action litigation alleging federal antitrust violations against all major retailers in the relevant industry.
- Representation of a retailer in defense of an industry-wide case alleging minimum resale price agreements among department stores and cosmetics manufacturers for prestige cosmetics and fragrances.
- Advised retailers in connection with merger and acquisition review by government agencies.
- Provided antitrust counseling on a variety of distribution issues relevant to retailers, including distribution agreements, resale price maintenance and minimum advertised pricing, bundling and discounting, and price discrimination.
