Construction Law: Alternative Dispute Resolution

Crowell & Moring has been a leader in promoting the use of alternative means of dispute resolution ("ADR") to resolve construction disputes.

We represented the construction contractor in the much-publicized "Tenn-Tom Mini-Trial" that successfully resolved a $45 million differing site conditions claim against the US Army Corps of Engineers arising out of construction of the Tennessee-Tombigbee Waterway.

On the Fort Drum, New York project, we represented the prime contractor before an ADR panel whose nonbinding decisions encouraged the contractor and the Corps of Engineers to settle a complex of claims valued at over $100 million.

At the state level, we were lead counsel for the general contractor in a mini-trial that led to the settlement of claims against the Pennsylvania Department of Transportation arising out of a major highway rehabilitation project in Philadelphia.

We have also successfully mediated multi-million dollar claims involving the Cerritos Performing Arts Center, the Escondido Center for the Performing Arts, the City of Carson's Sports Complex, and an assisted living facility.

Many of Crowell & Moring's construction attorneys also regularly act as arbitrators and mediators, have written articles and reports on ADR, and have lectured on effective use of litigation alternatives.
