Appellate
You probably have as much riding on your appeals as on your trial court and agency efforts, perhaps more. Appeals often have greater significance than merely resolving the case at hand. Our Appellate Practice Group has represented our clients in hundreds of cases in federal and state appellate courts nationwide, in complex matters spanning a wide range of substantive practice areas, including intellectual property, terrorism/foreign relations law, and the full range of environment and natural resource issues, from the Clean Water Act, to the Endangered Species Act, to the Surface Mining Control and Reclamation Act to climate change.
Recognizing the unique demands of appellate practice, Crowell & Moring has assembled a highly experienced group of appellate advocates. Our team includes attorneys who have clerked on the United States Supreme Court and Courts of Appeals, including the Federal Circuit. Other members of our group have gained extensive appellate experience while serving in the U.S. Department of Justice or U.S. Attorney’s Office. Our attorneys have briefed and argued numerous cases before the United States Supreme Court and other appellate courts across the country.
Our appellate work includes cases growing out of our original trial and agency representations and cases we first enter as appellate counsel. In addition to representing the parties to appeals, we frequently prepare amicus curiae briefs on behalf of trade associations, industry coalitions, and others, offering the court perspectives different from those presented by the parties themselves.
The judges who will decide your appeal are generalists. Their reaction to your appeal will likely reflect the unique breadth of experience provided by the case load of an appellate judge. Our appellate specialists share that breadth of experience. Our expertise reflects sensitivity to the issues and concerns that motivate appellate judges. The attorney who takes the lead on your appeal may well be one immersed in one of our substantive specialties or may be an attorney specializing in appellate advocacy. Your chances of success on appeal will be enhanced if your appellate strategy, briefs, and oral arguments reflect the insights of both. Crowell & Moring LLP's team approach allows us to meld our substantive law and appellate expertise to produce winning briefs and oral arguments.
