International Trade - Trade Litigation


Given the fast-paced and politically charged nature of customs and international trade disputes, the government often makes mistakes. Crowell and Moring’s trade lawyers are experts at resolving these issues administratively, but when litigation is the only way to right the wrong, our lawyers an in-depth understanding of the underlying regulatory regimes and issues with years of experience before the courts in this area.

A particular strength of Crowell’s practice is litigation in the U.S. Court of International Trade. From disputes under the Customs laws to challenges of antidumping determinations issued by the Commerce Department and International Trade Commission, Crowell lawyers have secured significant victories in the CIT for our clients on a variety of trade issues.

    Victory over the Commerce Department establishing beneficial rules for the treatment of input costs in NME antidumping calculation methods
  • Representation of an importer of herbicides from Brazil in litigation arising from Customs and Border Protection claims that the importer under-valued its imports
  • Representation of a California producer of aerospace fasteners in litigation brought by the Customs Service alleging fraudulent importations
  • Representation of a major U.S. distributor of office products in a criminal and civil investigation of its imports from China, which were alleged to have been manufactured using prison labor
  • Litigation establishing eligibility of a particular manufacturing process for drawback, based on a motion for summary judgment
  • Litigation of a Customs penalty proceeding concerning valuation of chemicals from Australia and France
