Individual Labor Law and Social Security Law
In most EU countries, individual labour law is a major issue for companies since most of the rules governing the individual relationship between employers and employees, especially in case of termination, are mandatory and often complex. In addition, non compliance with these rules can have far reaching financial (e.g. severance pay equal to several years salary for the unlawful termination of a protected employee) and operational consequences (various laws provide for criminal sanctions in case of non-compliance).
Our team has developed extensive expertise in this intellectually demanding field but always in the context of the commercial needs of your business. We assist clients in a number of areas which include:
- Drafting employment agreements, termination agreements, as well as service, management or consultancy agreements
- Drafting and enforcing non-compete agreements, non-solicitation agreements and other restrictive covenants
- Drafting and reviewing work regulations
- Drafting employment policies and employee handbooks
- Drafting and reviewing incentive plans and providing advice concerning executive compensation packages
- Providing advice and support during restructuring, redundancies and change in management programmes
- Providing advice and trial practice regarding individual termination (including unfair dismissal claims and termination of protected workers)
- Providing advice concerning discrimination, harassment and related issues
- Providing advice regarding organization of working hours, maternity and parental rights, career break schemes
- Providing advice regarding acquisitions, sales and other corporate transactions
In addition to these ‘traditional' aspects of labour law, we also defend clients in criminal proceedings in which they are involved as a consequence of non compliance with mandatory labour law legislation (in particular health and safety provisions).
Finally, in the area of social security law, we have acquired particular experience in sham self employed issues by assisting various clients in Court (claims issued by former self employed contractors and/or the National Security Office) but also by performing proactive measures in order to organize the status of sham self employed persons occupied within the undertakings.
