Crowell & Moring Partner Steve McBrady Named Law360 2018 Government Contracts "MVP of the Year"

Washington – December 11, 2018: Crowell & Moring LLP is pleased to announce that Steve McBrady, a partner in the firm’s Government Contracts Group, has been named a Law360 2018 “MVP of the Year” in the government contracts category. The editors selected winners from nearly 1,000 submissions across 35 practice areas who have distinguished themselves from their peers by securing hard-earned successes in high-stakes litigation, complex global matters, and record-breaking deals.

Law360 highlighted McBrady’s leadership in litigation matters, including a high-profile set of Affordable Care Act cost-sharing reduction payment cases. Most notably, he secured a win for Montana Health Co-op when the Court of Federal Claims ruled in a case of first impression that the federal government owed the nonprofit health insurance cooperative $5.3 million in ACA cost-sharing reduction payments—a decision establishing that the payments were mandatory under the ACA, despite Congress failing to appropriate specific funding.

McBrady told Law360 that the ACA-related cases are some of his most challenging. “All things related to the ACA are under the microscope,” McBrady said. “Our clients went into the exchanges and performed exactly as the law required and are now in court trying to enforce the government’s obligation to perform as the government was required. These are not easy cases, but they’re really important.”

McBrady also cited his positive relationships with Government counsel as a value-add to his clients, given the long-term relationships his clients have with the Government. “I tend not to litigate in a very acrimonious way, we try to disagree without being disagreeable.”

Outside of the courtroom, McBrady works to mentor young and diverse lawyers throughout the firm, and develop talent in the firm’s government contracts practice. He is also a member of the firm’s Government Contracts Group steering committee.
